Booking Conditions

Disclaimer

​

Whilst Wild Cycles may be able to adjust some of the activities in your booking to your fitness level, you should be in good physical condition and be able to participate in the activity you choose.

 

Wild Cycles Ltd will not be responsible for any adverse impact to your health or the onset or exacerbation of any existing conditions in relation to your participation in any of our activities of which you do not make us aware at the time of booking.

Making a booking

​

To make a booking you will need to complete a booking form on Wild Cycles’ website. Your booking will be confirmed once you have completed and submitted your booking and we have received the corresponding payment.

Following confirmation from Wild Cycles these booking conditions will become applicable to you. Please ensure you read these carefully as they form the basis of our contract with you and set out your rights and obligations in relation to the services provided by Wild Cycles Ltd, a company with number 12740929 and its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ referred to as “us”, “we”, or “our” in these booking conditions.

Prior to booking - please ensure you understand the activity details, the itinerary and booking conditions. If you have any questions - please contact us for clarification.

To make a booking and join one of our activities - you must be a minimum of 18 years old.

 

The online booking form must be completed for each participant. Each booking submitted is treated as an offer by you to purchase the activity in accordance with these terms and conditions. We will acknowledge receipt of your booking and payment by email at which point a contract will be entered into between you and Wild Cycles.

 

Any questions or errors should be directed to us.

Cancellation or transfer by you

​

If you need to cancel your booking - you will need to let us know as soon as possible. If severe weather is forecast on your booked dates or if you need to cancel for other reasons, we will do our best to find alternative dates for you. If not - Wild Cycles will refund you as follows:

100% refund (minus a small processing fee of 2.5%) when cancelled 3 or more weeks prior to your tour, 75% refund if cancelled 1- 2 weeks prior and 50% if cancelled 3-6 days prior to your tour.

Cancellation by us

​

We reserve the right to cancel your booking or suspend our services in the following (but not limited to) circumstances:

  • conditions beyond our reasonable control - for example, war, riot, civil or political unrest, terrorism, poor weather conditions or technical problems

  • the minimum number needed has not been met (we will advise you of this no later than 5 days prior to your booking)

 

If your booking is cancelled due to above circumstances or any other reasons which are not a result of something you have done or failed to do in accordance with these conditions, we will endeavour to book alternative dates agreeable to you. If this is not acceptable to you we will refund you in full.

 

Where Wild Cycles cancels your booking for any reason, a full refund will be issued to you.

Transfers

​

Any person who has booked and paid for an activity can transfer their booking to another person who satisfies all of the applicable conditions and who confirms they agree to and accept these conditions. Notice of the transfer must be made a minimum of 72 hrs of the commencement of the activity otherwise we may be unable to accept any transfer.

​

Insurance

​

In order to participate you must have adequate insurance cover for your property and equipment including bicycles intended for your use, medical expenses and the cost of repatriation should you become too ill to continue with your activity.

​

Prices

​

The price of the activity is set out on our website and as indicated on your booking.

Pricing quoted in our catalogue may change at any time up to the point a contract is entered into.

Your booking

​

Your booking is subject to the understanding that you accept:

  • Risks and hazards of your activity, including the dangers inherent in cycling on and off-road and all activities associated with the activity you have booked

  • The potential for delays, alterations, loss or damage to property, inconvenience and discomfort

  • The need for flexibility. Schedules may be subject to change and as such you acknowledge and accept the potential for delays and amendments which could cause  inconvenience, discomfort or disappointment. We will notify you of essential significant changes as soon as possible. If you are unsatisfied with the changes - we will work with you to find agreeable alternatives and if not - provide you with a proportionate refund. Refunds will not be given for costs (for example - travel costs) not booked through Wild Cycles.

Following commencement of our services, should we be unable to provide a significant proportion of the agreed activity we will endeavour to make alternative arrangements.

It is essential you comply with Wild Cycles’ representatives’ instructions. Completion of the booking process implies your agreement to comply with these instructions where they are given to you.

If you commit inappropriate, offensive or illegal actions whilst on an activity and your behaviour is causing or likely to cause danger, distress or annoyance to others - Wild Cycles reserves the right to terminate our services without any liability.

We cannot at any time guarantee the composition of the group in terms of age, nationality, gender, singles and couples and we are unable to take this into account in arranging your activity, even if you have provided a preference to us.

Travel arrangements and other products you purchase separately do not form part of our and we shall not be responsible for anything in connection with them.

 

It is your responsibility to ensure that you are aware of any travel arrangements prior to or during your activity.

If you fail to arrive in time for whatever reason, you will be responsible for any additional expenses you may incur.

Any information provided by Wild Cycles such as (but not limited to) weather, clothing, special equipment, terrain is given in good faith and should be taken as guidance only.

It is your responsibility to check and verify this information before depending on it.

You take part at your own risk.

​

Medical and Special Requirements

​

Cycling and outdoor activity is physically demanding and it is your responsibility to ensure that you are sufficiently fit and healthy to complete your chosen activity and to ensure you have the necessary skill and capability.

Prior to the start of our services, you will be asked to complete a disclaimer on which you should disclose any conditions which may affect your ability to participate in your activity including any medical or health conditions or food or other allergies. We may suggest adjustments to your chosen activity or, in some cases, advise that you cancel with us in which case you will be provided with a full refund. Please note that it is your responsibility to provide all relevant information to us which is relevant to your participation.

 

You should inform us immediately if - within 2 weeks prior to - or during your activity you have or develop an infectious or contagious medical condition. In which case, Wild Cycles reserves the right to:

  • refuse to accept your booking;

  • cancel your trip; or

  • ask any member of your party to leave immediately, should we, at our reasonable discretion, consider it necessary to protect the health of others.

 

You should arrange your own insurance to cover medical expenses and emergency repatriation in the event of illness or injury; personal liability (third party cover); legal expenses; baggage and personal effects.

Behaviour

​

Your behaviour must at all times be appropriate and sensitive to companions and other users of trails, campsites eateries, shops etc. Offensive or illegal behaviour may result in the police being involved or the remainder of your activity being cancelled.

​

Wild Cycles’ liability to you

​

We will not be liable for any losses that you suffer as a result of any breach of our contract (including these conditions) except those losses which are reasonably foreseeable to both of us at the time we enter into the contract with you.

We shall not be held liable for any damages or loss (whether direct or indirect and howsoever caused) arising from the total, or partial failure to provide your trip if such failure is:

  • attributable to you, your own actions or omissions or those of any member of your party; or

  • unforeseeable or unavoidable and attributable to a third party unconnected with us or any of our sub-contractors; or

  • as a result of unusual and unforeseeable circumstances beyond our control including but not limited to strikes, war, civil or political unrest or government action; or

  • as a result of any event which Wild Cycles or any of its suppliers of produce and  services could not foresee or forestall; or

  • an action or omission on the part of any accommodation provider; or

  • due to the theft of bicycles or injury as a result of cycling either on or off road and in particular injuries as a result of either inadequately maintained and/or serviced personal equipment or failure to wear the correct safety equipment most notably cycle helmets, unless demonstrably due to our negligence; or

  • considered to be indirect or consequential loss or damage.

 

Our liability will also be limited in accordance with and/or in an identical manner to direct damage or loss of any nature caused, or contributed to, by any defect in or failure (whether partial or complete) of any travel services not provided by us, and which we could not reasonably be expected to be responsible for.

Except for those areas for which we do not seek to exclude liability, our total liability to you is limited to twice the basic tour price per person shown on the invoice.

Where we provide any food or drink as part of your activity, we will only be liable for any harm to you or damage to your property to the extent that is reasonably foreseeable. Please ensure that you tell us about any allergies or other conditions which may affect the goods we provide to you as part of your activity.

​

Any timings set out as part of your booking are intended to be indicative only. The timings may vary depending on the size of each group and the levels of ability of the individuals. We will not be liable for any loss you might suffer as a result of any change in the timings, unless this is foreseeable.

​

You accept that, if leaving your car parked in any location in your activity, that your vehicle and contents are left at your own risk. We do not accept responsibility for any loss or damage to vehicles and their contents.

We shall have no liability to you if we are unable to fulfil your booking due to an event of Force Majeure.

We only supply the services for personal and private use. If you are a company and use the services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

These conditions do not seek to limit or exclude our liability in any way which is not allowed by law.

​

We do not seek to exclude our liability for death or personal injury that is caused by our negligence.

​

Safety and Security

​

You must be aware of the inherent risks associated with cycling on and off-road.You take part at your own risk.

Wearing a quality cycle helmet which conforms to the latest safety standards wearing of  appropriate clothing is mandatory.

​

Rides feature steep, climbs and descents, loose, slippery, uneven and rutted surfaces requiring a good level of fitness and riding skills. Featuring a mix of loose and hard surfaces, flint, roots and ruts - they include gravel, woodland trails, sand, grassy fields, bridleways, public roads and lanes. It is therefore essential that you have suitable cycling experience. Routes use and cross public roads used by motorists (light, medium and heavy vehicles) where extra care and vigilance is required. Conditions, degree of difficulty and speed will be significantly impacted by weather conditions. Check the weather forecast beforehand.

​

Familiarise yourself with the route distances, terrain profiles and conditions and make yourself aware of the risks and hazards associated with undertaking your chosen activity.

​

Although representatives from Wild Cycles are present, as a rider you are responsible for your own safety and decision-making during the ride. Know your capabilities and limits and adapt the routes to suit your ability and your preferences.

​

You are required to follow safety advice provided.

​

Wild Cycles is not responsible for the loss or damage to your equipment and possessions. Your personal possessions are your own responsibility.

​

Equipment and Accommodation

​

You are expected to use the equipment and facilities provided to you with care and to keep them in a clean and tidy condition.

We reserve the right to charge you for any extra cleaning, missing items or damage.

Accommodation providers have their own terms and conditions which you agree to abide by.

If utilising your own bicycle it is your responsibility to ensure that it is adequately maintained, safe to ride, appropriate to the terrain and is insured.

All your equipment and property it is your responsibility to ensure it is appropriately maintained and insured.

We will take all reasonable care when transporting equipment and property, however we are not responsible for any loss or damage incurred during the experience or while it is in transit unless it is foreseeable.

Bike hire/Rental terms and Conditions

​

By placing your bike hire booking - you acknowledge and accept the following terms and conditions:

​

Bike equipment rented to you remains the property of Wild Cycles.

​

NB for your own safety:

  • You must wear your own quality cycle helmet which conforms to the latest safety standards.

  • You are responsible for your own safety for the rental period.

  • It is your responsibility to ensure that you have the appropriate skill and capability to safely and legally operate the bike you have hired from Wild Cycles.

 

You may not sell, hire out or otherwise part with the possession thereof.

You undertake to take care of and not misuse the equipment and to return it with all accessories in the same condition as it was when you took receipt of it (wear and tear excepted).

You must ensure that all bike equipment is adequately secured when not in use. If you leave your bike unattended it must be secured through the frame and any quick-release wheels to an immovable object using an approved lock (keyed armoured cable lock, keyed chain lock set, keyed D-lock or U-lock).

You must not use the equipment while under the influence of alcohol or drugs and immediately notify us in the event of the breakdown or loss of the equipment.

Wild Cycles can charge you for any damage or loss during the rental period caused by your act of negligence or omission.

Wild Cycles reserves the right either during or after your trip to recover from you, the costs of:

  • Compensation we may pay, resulting from your acts or omissions; and/or any property or accommodation damage caused by you or members of your party; and/or

  • Other charges, fees or levies we may incur resulting from your action or inaction and from any breach of these conditions.

  • Cost of repair or replacement of Wild Cycles' property damage or loss resulting from your action or inaction.

Compensation payable by you

​

We reserve the right either during or after your trip to recover from you, the costs of:

  • Compensation we may pay, resulting from your acts or omissions; and/or any property or accommodation damage caused by you or members of your party; and/or

  • Other charges, fees or levies we may incur resulting from your action or inaction and from any breach of these conditions.

  • Cost of repair or replacement of Wild Cycles property damage or loss resulting from your action or inaction.

General

​

These booking conditions (or any part of them) may only be waived by one of our directors in writing.

These booking conditions are governed by English law and both you and we agree to submit to the non-exclusive jurisdiction of the English courts.

By booking, unless you tell us otherwise, you consent to our use and use by any one of our partners and/or sponsors - of any likeness or image of you secured or taken during a Wild Cycles activity without charge in all media (whether now existing or in the future) for bona fide promotional materials - such as brochures, videos and the internet.  This personal data, together with all other personal information you provide when making your booking with us or otherwise, will be processed by us in accordance with our privacy policy.

If any part of these conditions is unenforceable (including any provision in which our liability to you is excluded) the enforceability of any other part of these terms and conditions will not be affected.

By booking you accept that, with the exception of any liability which cannot be excluded by law, Wild Cycles Limited shall have no liability for any loss or damage you may suffer as a result of participation in your chosen Wild Cycles activity. Furthermore, you will indemnify and hold Wild Cycles Limited, its officers, agents and employees harmless from and against any and all expenses, losses, liabilities, damages and costs of any type incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case, arising from your participation.

All activities, restaurants, establishments and third party providers we may refer to are not included in the activities (unless explicitly stated otherwise). These are not under our direct control or responsibility. Mention of these establishments are purely indicative.

Data Protection

​

Except where expressly permitted under the Data Protection Act 1998, we will only use your personal data in connection with your Booking arrangements, unless you agree otherwise.  

We will keep your personal data secure in accordance with our obligations under the Data Protection Act 1998.
